A Guardian Ad Litem (“GAL”) is a neutral 3rd party that is appointed by the court to conduct an investigation into issues, prepare an extensive report based on factual findings, and make recommendations to the court on issues. A Guardian Ad Litem is often appointed in complex divorce or custody cases where parties are unable to agree on issues relating to their children.
A skilled and experienced Guardian Ad Litem prepares an extensive report that articulates, in an unbiased way, positions of the parties, facts obtained from independent sources (like medical, school or DCF records), and input from witnesses (called collaterals). A thorough investigation and well written report can aide the parties in resolving issues and assist the judge in streamlining information for purposes of trial.
